Airline Certificate Terms and
Conditions
Offer
Entitlement
This
offer entitles the recipient and traveling companion(s) to receive a total
of four (4) round-trip airline tickets in accordance with these Terms &
Conditions. This certificate Contains two (2) Reservation Forms. Each
Reservation Form is valid for two (2) round-trip airline tickets, provided
the hotel accommodations (one room per Reservation Form) are booked and
purchased through First Priority Travel LLC (FPT) for the number of
consecutive nights shown on pages 15 -18 (based on departure city and
destination), choosing from the hotels and rates listed within this
brochure.
You may submit both Reservation Forms together to receive a total of four
(4) round-trip airline tickets for one trip provided you purchase two
separate hotel rooms through FPT, each for the required minimum number of
nights. Or, you may submit the Reservation Forms separately for two
separate trips.
This offer does not permit you to request, book or purchase your hotel
accommodations directly with the hotel or through any source other than
FPT. If you are requesting to travel to Orlando, please indicate a first
choice and second choice hotel on the Reservation Form FPT reserves the
right to issue e-tickets.
Who Is Eligible For This Offer
Only
persons who have and submit an original, numbered Reservation Form,
contained in this brochure, are eligible for this offer. The first-named
traveler shown on the Reservation Forms, who is also the person who signs
the Reservation Forms, must be 21 years or older. Traveling companions may
be younger than 21 years provided at least one person in each hotel room
is 21 years or older.
This brochure (certificate) may be distributed only by authorized
businesses and must be given free of charge, as a promotional tool, to the
end-user traveler. No part of this brochure (certificate) may be sold or
resold to the end-user traveler. Any such sale will invalidate eligibility
and all redemption rights.
What Is Not Included In This offer
This
offer does not include hotel tax, airfare/airport taxes and applicable
fees, fuel surcharge (if applicable), cruise-related fees (if applicable),
all of which are payable to FPT.
This offer does not include resort fees, maid gratuities, gratuities of
any kind, telephone calls, room service charges, a charge for rollaway
beds or cribs, if applicable, or any incidental room charges, all of which
will be payable directly to the hotel. This offer does not include any
item that is not specifically stated as being included.
This offer does not include ground transportation. This offer does not
include meals (unless meals are specifically stated as bring included in
the hotel description). This offer does not include insurance, although
trip-cancellation travel insurance will be made available at an additional
cost.
This offer does not include inter-island airfare between Hawaiian Islands
or airfare between London and Paris or airfare between Rome and Venice and
which, if applicable, must be purchased through FPT at the prevailing
fare.
Hotel
Rooms, Hotel Rates and Rate Guarantee
Hotel rooms are "standard" unless stated otherwise under the hotel
listing. Room location will be at the hotel's discretion and is
typically assigned upon check-in. Sorry, no pets allowed.
The hotel rates listed in this brochure are per room/per night based
on 2 people sharing a room, and do not include taxes. These rates are
based on the published rack rates provided to FPT by the hotels at the
time of this printing. No promotional or other discounts, including
internet rates, apply.
The rates, seasonal dates and hotels are subject to change at any
time. FPT guarantees hotel rates only for confirmed reservations that
are paid in full at the time a hotel increase occurs. Once FPT has
been informed that a hotel rate increase will occur, FPT is under no
obligation to provide a grace period so that unpaid reservations can
be paid in full in order to qualify for a hotel rate guarantee.
All taxes (hotel, airline and cruise line related) and fuel
surcharges, if applicable, are subject to increase at any time without
notice. FPT reserves the right to invoice such increases if and when
they occur, regardless of whether or not a reservation is fully paid.
Advance Notice Requirements & Availability
You are required to provide just one travel date choice, in compliance
with these Terms & Conditions. FPT most receive the correctly
completed Reservation Form, by regular mail or by email, at least 45
days before your requested departure date. Please provide more advance
notice if possible. All reservations are subject to
availability. When
traveling to Cancun in the winter or summer or to Europe in the spring
or summer, we suggest you provide at least 90 days advance notice to
ensure availability. When requesting to travel during President's
Birthday Holiday in February, during March or during Thanksgiving
Week, be aware that availability sells out months in advance so plan
accordingly.
Correctly completed Reservation Forms are processed based on FPT's
availability of coach-class airline seats and hotel rooms as per our
contractual rates. Since we have a "free sell" relationship with our
suppliers (air carrier, hotel, cruise line), we will process all
correctly completed Reservation Forms as "available" until a supplier
informs us that certain dates are "unavailable" under our contract.
Availability for specific dates is not confirmed with the supplier
until we receive your payment (deposit or full payment). If, at the
time of confirmation, our supplier informs us that your requested
travel date is not available under our contract, we reserve the right
to offer alternate travel dates or alternate destinations/hotels, and,
in that rare event, we will contact you in as expedient a manner as
possible.
Blackout Dates
Travel is not permitted during any black-out period and may not begin,
end or overlap these dates: *All Destinations: Palm Sunday through
the Sunday after Easter, and December 16 -January 3. *Daytona Beach:
all Race Weeks (typically the first two weeks of February, first week
of March, first week of July, third week of October and Thanksgiving
week) and Spring Break (typically the last two weeks of March). *Ft
Lauderdale: Air/Sea Show (typically the first weekend in May), Boat
Show (typically the last week of October). *Miami Beach Boat Show
(typically the third week of February), Memorial Day Weekend, July 4th
Weekend. *The island of Hawaii: Ironman Triathlon (typically the last
week of September and the first week of October), other Hawaiian
Islands may be selected during this time period. *New Orleans: Sugar
Bowl (Jan 4-5), Mardi Gras (Jan 28-Feb 12,2002; Feb 17-Mar 4, 2003;
Feb 9-24, 2004; Jan 24-Feb 8, 2005; and so on, encompassing the two
weeks prior to Ash Wednesday); French Quarter Fest (typically the last
week of April); Jazz Fest (typically the first week of May). *London,
Paris, Rome, Venice: two weeks before and after Easter (which in 2002
is March 16 - April 14), June 16 - July 5,
August 27 - September 14.
Day-of-The-Week Departure/Return Restrictions
Any
departures/destinations requiring less than a 7-night stay may require
a Saturday night stay.
Cancun Combo (Orlando/Cancun) permits a Thursday departure only.
Cancun, Nassau, Hawaiian Islands, London, Paris, Rome and Venice
permit midweek departure/return only, as follows, based on total
number of nights stay:
3 Nights (Mon or Tues), 4 Nights (Thurs), 5 Nights (Wed), 6 Nights
(Tues or Wed), 7 Nights (Mon, Tues, Wed, Thurs), 8 Nights (Mon, Tues,
Wed), 9 Nights (Tues), 10 Nights (Mon), 11 Nights (Thursday), 12
Nights (Wed), 13 Nights (Tues or Wed), 14 Nights (Mon, Tues, Wed or
Thurs).
Hawaiian Islands Hotel Choices, Inter- island Airfare and Stop-Over
Option
Refer to the "Departure Cities" charts beginning on page 15 to
determine the total number of nights you must purchase through FPT
when traveling to Hawaii from your departure airport. You may select
from the hotels listed on page 7 for I, 2 or 3 of the total minimum
number of nights required, and then select from the hotels on page 8
for the remaining number of nights. Or, you may spend all of your
required number of nights at one or more of the hotels on page 8.
Airfare is provided to/from Honolulu on the island of Oahu. If you
select hotels on any other islands, you must purchase the inter-island
airfare through FPT at the prevailing fare ($74 per person per hop at
the time of printing).
The "Stop-Over Option" permits you to "stop-over" in Las Vegas, San
Francisco or San Diego on your way to and/or from Hawaii. If you elect
to "stop-over" in both directions, you may choose the same "stop-over"
city for each direction or a different "stop-over" city for each
direction.
With the "Stop-Over Option", you may substitute up to a total of 3 of
your required number of nights for the Hawaii destination to stay in
one or more of the "stop-over" cities by selecting from the Las Vegas,
San Diego or San Francisco hotels shown only on page 7. Your remaining
number of nights in Hawaii must then be selected from the hotels on
page 8. (A maximum of 3 nights total is permitted at the hotels shown
on page 7, regardless of where the hotels are located.)
Or, you may spend all of your required number of nights in Hawaii
and extend your vacation with a "stop-over" in your choice of Las
Vegas, San Diego or San Francisco in which case you may purchase the
extra nights hotel accommodations in your "stop-over" city through us
or go on your own. (Please see the paragraph entitled "Extended
Vacation Requests" below for important information regarding possible
"flight surcharges)
All "Stop-Overs" must be requested on your original Reservation Form
submission and will be charged a "stop-over flight surcharge" ($99 per
person per stop-over, at the time of printing), payable to FPT.
Expiration Date and Expiration Extensions
This offer expires 18 months from the Issue Date shown on the
Reservation Form. Travel must be completed by expiration. You may
request an extension of up to an additional 6 months (to total 24
months from the Issue Date) by mailing a signed, written extension
request to: First Priority Travel, 100 E. Pine St., Site 202, Orlando
FL 32801. FPT must receive your written request before the original
expiration date of 18 months from the Issue Date.
How To Request Your Reservations
Complete one Reservation Form for each set of two round-trip airline
tickets you are requesting. Each Form requires the purchase of one
hotel room for the minimum number of nights required, based on your
departure airport and requested destination.
Be sure your requested travel date does not begin, end or overlap any
Black-Out Date (see the list of Black-Out Dates above). Be sure your
requested travel date complies with any day-of-the-week restrictions
associated with your requested destination (see the list above).
Submit your correctly completed Form to FPT so that we receive it no
less than 45 days (or 90 days if requesting Europe or Cancun) before
your requested departure date. You may submit your Form either way
below (do not send it both ways):
Regular Mail to: First Priority Travel, 100 E. Pine St., Suite 202,
Orlando FL 32801. Email: go to
www.fptravel.com, click on “Request A Reservation”, enter the
Package Code and Serial Number found on the Reservation Form enclosed
in this brochure, complete the Form and submit it.
If you do not complete the Form correctly (in compliance with the
Terms & Conditions), or if we do not receive your Form with the number
of days advance notice required, the Form will be returned to you for
correction. If we know your requested travel date is not available, we
will return the Form to you for an alternate choice. When you resubmit
the Form for any reason, you must, again, comply with all Terms &
Conditions, including the advance notice requirement.
Deposit and Payment Requirements
Do
not send any money when you submit your Reservation Form.
When we receive your correctly completed Reservation Form, we will
determine initial availability. Assuming your request is available, an
Invoice/Statement will be generated and sent to you in the same way
you submitted your Reservation Form (by regular mail or by email). The
Invoice/Statement will outline the travel components intended to be
confirmed upon receipt of your payment and will specify the payment
requirements.
You will be required to pay the full amount shown on the
Invoice/Statement, so that FPT receives it within 15 calendar days
from, and including, the date the Invoice/Statement was generated,
under the following circumstances (please read the "Payment Form"
section, below): *If you are requesting to travel
in 60 days or
less.
*If you are requesting to travel to Mexico, London, Paris, Rome or
Venice. *If you are requesting
to travel during President's Birthday Holiday in February, or during
March or during Thanksgiving Week.
Otherwise, you will be required to pay a deposit of $125 per person,
so that FPT receives it within 15 calendar days from, and including,
the date the Invoice/Statement was generated. The balance must then be
received by FPT no less than 45 calendar days prior to departure
(please read "Payment Form" section below).
In either case, the deposit or full payment must be received by FPT,
in acceptable payment form, by the due date or your reservation is
subject to automatic cancellation.
If you submit your Reservation Form by email, you must mail the
corresponding original, numbered Form (found in this brochure) with
your deposit or full payment or your reservation is subject to
automatic cancellation.
Payment Form
All
deposits and/or payments made to FPT must be in the form of a cashier's
check or money order, made payable to First Priority Travel.
Requests To Travel With Another Party
You may
submit two Reservation Forms together, requesting to travel together.
However, you may not submit more than two Reservation Forms with the same
requested departure date and destination
If There's More Than 2 People In Your Party
You may submit both of the Reservation Forms found at the back of this
brochure together to receive a total of four round-trip airline tickets as
long as you purchase two separate hotel rooms through FPT for the minimum
number of nights required, choosing from the hotels and rates listed
within this brochure.
Or, if you are traveling with young children and want them to share a
hotel room with you, then use one Reservation Form to receive two
round-trip airline tickets (for the adults) and purchase the extra airline
tickets through FPT, at the lowest possible fare, to coordinate with your
flight schedule. Depending on the age of the children and the hotel's
policy, there may or may not be an "extra person" room charge. Most hotels
allow up to 2 children under the age of 16 to share the room with their
parents, using the existing bedding, at no additional room charge (there
may be a charge for a requested roll-away bed or crib).
Extended Vacation Requests
You may
purchase extra nights through FPT at the hotel rates shown in this
brochure. You may also request to extend your vacation (return flight)
without purchasing extra nights through FPT, provided that the extension
does not cause any portion of your travel period to fall within any
black-out dates applicable to your requested destination. If you want to
extend your return flight, but not purchase the extra nights hotel
accommodations through FPT, your request to do so must be made in writing
in the "Comments" section of the originally submitted Reservation Form.
In either case, if the extended vacation request causes the cost of the
airline tickets to increase, you will be required to pay FPT a flight
surcharge equal to the difference in cost. The amount of the flight
surcharge will not show on your original Invoice/Statement because the
surcharge is not determined until the airline tickets are ordered after
you have submitted full payment for the hotel room and taxes.
Extended vacation requests are subject to availability and the airline's
rules regarding the maximum number of days allowed between departure and
return flights.
Vacation Revisions
Once a
Reservation Form has been received and processed, the primary
(first-named) traveler's name may not be changed. Other revisions may be
requested, subject to availability and compliance with all Terms &
Conditions. Change requests must be made in writing and sent to First
Priority Travel, 100 E. Pine St., Suite 202, Orlando FL 32801. A change
fee of $25, in the form of a cashiers check or money order, must accompany
the written change request. Written change requests received by FPT within
15 calendar days from the date the original Invoice/Statement was
generated are not subject to a change fee. Once airline tickets have been
ordered, changes are no longer permitted and cancellation policies will
take effect.
Cancellations & Refunds
All
requests and reservations are subject to automatic cancellation if the
deposit or full balance payment, in the acceptable payment form, is not
received by the due date. If a cancellation occurs for this reason, you
may re-instate your ability to request a different travel date, in
compliance with all Terms & Conditions and subject to availability,
provided you make a request in writing and submit the written request with
a re-booking fee of $25, in the form of a cashiers check or money order,
to: First Priority Travel, 100 E. Pine St., Suite 202, Orlando FL
32801. All cancellations of confirmed reservations must be made in
writing and may be subject to cancellation penalties based on the work-day
date FPT receives the written cancellation request. Written cancellation
requests received before FPT has ordered airline tickets may request a
refund, less a $50 cancellation fee, or may request an alternate travel
date, in compliance with the Terms & Conditions and subject to
availability, in which case previously paid money, less a $50 cancellation
fee and a $25 change fee, will be applied. Written cancellation requests
received after FPT has ordered airline tickets but no less than 14
calendar days prior to scheduled departure may only request an alternate
travel date, in compliance with the Terms & Conditions and subject to
availability, and are subject to a $50 cancellation fee and $25 change
fee, plus penalties and change fees charged by the airline or cruise line
(if applicable). Airline tickets and travel documents must be submitted
with the written cancellation request. Cancellations received by FPT less
than 14 calendar days prior to departure and no-shows are not eligible to
re-book or receive a refund of any kind.
If, after paying a deposit or full payment, FPT notifies you that your
reservation is "not available", you may request a full refund of all money
previously paid to FPT towards this reservation, without penalty, or you
may apply all money towards an alternate booking of this offer, subject to
availability, without penalty.
Responsibility
It
is your responsibility to ensure that, when traveling to the Bahamas (by
air or by cruise), Mexico or Europe, you and all member of your party
possess a valid passport or other identification that you have verified in
advance will be acceptable to the country you are visiting
(Failure may result in the forfeiture
of all travel arrangements and forfeiture of all money paid for those
travel arrangements).
First Priority Travel, LLC (FPT) is solely and fully responsible for the
booking of the travel offer(s) made in this brochure. FPT has contracted
with independent contractors (suppliers) to provide the services included
in this offer. Neither FPT, the Sponsor, nor any of either company's
affiliates, employees or representatives are responsible for the acts
and/or omissions of these independent contractors, the suppliers, and
their employees, agents or representatives. All reservation requests are
accepted subject to the Terms & Conditions imposed by FPT. All bookings
are processed subject to the conditions imposed by the suppliers,
including airline, cruise line, hotel, insurance, car rental and other
companies, firms or persons concerned with the bookings and FPT will make
no refund in the event of their delay, cancellation, overbooking, strike,
force majeure or for elements of the package not used by the customer or
traveler. FPT gives notice that in issuing tickets and coupons for
transportation and in making arrangements for hotels or other
accommodations, it is acting as an agent only for the companies providing
or offering the transportation and accommodation and accordingly that FPT
will accept no responsibility for liability in respect of either person or
property for any loss, damage, injury, accident, delay or irregularity
however happened, sustained or suffered in or during and trip or in the
carrying out of any arrangements booked by and through FPT.
Do
not rely upon representations other than those included in these Terms &
Conditions.
FPT assumes no responsibility for any representation, verbal or
written, made in Conjunction with this offer by any company, firm or
person other than what is specifically stated in these Terms & Conditions.
The Terms & Conditions cannot be changed or amended.
If
circumstances beyond FPT's control require changes to be made to the
offered hotels or itineraries, FPT reserves the right to substitute hotels
of similar quality or make changes to the itinerary. FPT will not be
responsible to any person for expense, loss of time & money, or other
circumstance resulting from a change in itinerary or hotel substitution.
FPT is not responsible for any electronic, computer, telephone, security,
virus or any other problem, loss, cost or damage related to the use of
www.fptravel.com.
First Priority Travel, LLC is registered with the State of Florida as a
Seller of Travel, Registration No, ST33796.
This
offer is void where prohibited by law. Submission of the Reservation Form,
by mail or by email, to FPT constitutes consent to all provisions of the
Terms & Conditions. A contract is made when your reservation and payment
are accepted by FPT at Orlando, Florida, and any dispute shall be governed
by Florida law and shall be litigated, if at all, in and before a Court of
competent jurisdiction in the 9th Judicial Circuit in Orange County,
Florida USA to the exclusion of the Courts of any other State. The party
prevailing in any legal action shall be entitled to an award of all legal
cost and expenses including a reasonable sum for attorney fees and costs
on appeal.
